Professor Meng Qinguo, who is a famous civil jurist, as well as a professor of Wuhan University visited Law School of Southeast University, and gave a excellent lecture named “Absence of Modernity in the General Rules of Civil Law” on April 27th, 2017. The lecture is the forth of “Series Lecture on Law of Southeast University 115th Anniversary”, which is hosted by professor Wang Jinyuan.
There were four parts in total. Firstly, professor Meng explained the premise and performance of modernity, it required a modern civil code. On the grounds of modernity, our General Principles of Civil Law is General Rules of Civil Law in nature, but is Germany civil law in shape. Then, professor Meng sort out the history and origin of the General Rules of Civil Law article by article. He pointed out that there are not enough innovation in the general rules.
Next, professor Meng summarized differences between the General Principles of Civil Law and the General Rules of Civil Law. Some of these alteration is useless, some is not enough, some is even wrong, all reflected the absence of modernity in the General Rules of Civil Law. Finally, professor Meng made a concrete explanation about the absence of modernity in several systems.
Professor Meng’s sense of humor deeply impressed the audience at present. At the end of the lecture, professor Meng spent about 40 minutes answering questions, and gave notes to students.
