Professor Ye Jinqiang, the dean of Law School of Nanjing University, as well as a visiting scholar of Humboldt-University zu Berlin, held a lecture named “Interpretation of the new General Rules of Civil Law” at Law School in Southeast University on May 10th, 2017. Professor Shi Jianhui served as the host of the lecture.
Professor Ye analyzed the new General Rules of Civil Law article by article. He thought the first chapter stipulated the basic value of civil law, which was very meaningful. The second chapter affirmed the legal capacity of fetus. It’s a big improvement, but not complete enough. The third chapter provides the credibility of legal entity registration. It meant a lot but required further regulation. And the forth chapter was about unincorporated organization. Professor Ye pointed out that the unincorporated organization was a temporary connections between rights and obligations, which could be broken anytime. The fifth chapter mainly came from “Property Law” and “Contract Law”. As the fact that these two law has already existed in our country, there is no need to put it in the General Rules of Civil Law. The protection of personality rights should be emphasized, because there were no solely “Personal Law”. Then professor Ye made a distinction between legal act and intention in article 134, 142, 151 and 153. He also evaluated article 171,172 in the seventh chapter about proxy. At last, professor Ye mentioned that most articles about civil responsibility should be deleted.
In the end of the lecture, professor Ye answered students’ questions. His opinions were sharp and convincing, which impressed students and teachers at present.
