Professor Chen Jialin was invited to give a lecture named “Justifiable Defense in China and Japan – based on Yuhuan’s Case” in May 13th. The lecture was hosted by professor Ouyang Benqi.
At the first, professor Chen pointed out that there is need to combine with backgrounds and environments when studying comparative penal law. To some extent, it is the same between China and Japan when thinking about social system, public psychology and historic backgrounds. Yuhuan’s case has caused big influence to society, and the study of this case would have a certain significance to the development of criminal law.
On the basis of the differences of Justifiable Defense between China and Japan, professor Chen talked about his own opinions about Yuhuan’s case, from the perspective of Japanese criminal law. He thought that the basic facts didn’t fit in the standards of Justifiable Defense, and it was more like excessive defense.
