Professor Nakata Yukang Addressed Lecture on “Summary of the Japanese Civil Law Amendment”

On November 1st, 2018, Professor Nakada Yukang, a famous Japanese civil jurist, an honorary professor of the University of Tokyo, and a teacher of Waseda University, was invited to give a lecture at law school in Southeast University. The title of the lecture is “Summary of the Japanese Civil Law Amendment”. This lecture was presided over by Professor Shi Jianhui from the law school in Southeast University and translated by Associate Professor Gao Xiang from the law school in Southeast University. 

First of all, Professor Nakada introduced the history and structure of Japanese civil law, which is elaborated from the following three aspects: the formulation and revision of civil law, the issue of civil law—the incomprehensible and hollow language of language, and the background of civil law revision.

Later, Professor Nakata introduced the main changes of Japanese civil law: First, the content of the rules: clear the jurisprudence of most jurisprudence, clarify the basic principles and concepts, and clarify the relationship with other laws. Second, there are four representative provisions in the modernization of the content of the rules: the modification of the creditor system; the statutory interest rate; the protection of the guarantor; and the relevant provisions of the new format clause. At the same time, Professor Nakata said that there are also many contents of the civil law that have been reviewed but have not been revised.

Finally, Professor Nakata said that the part of the Japanese civil law contract-centered credit law was amended, but the civil law revision is still continuing.
