On December 20, 2018, Southeast University Law School held the last lecture of this semester, inviting Justice Hu Yunteng, former vice president of the Second Circuit of the Supreme Court of the Supreme Court to deliver lecture themed on “From the case of Nie Shubin to see occurrence, discovery and correction of the erroneous cases”.
Justice Hu Yunteng was the retrial judge of the Nie Shubin case. He is a scholar-type judge with rich academic achievements. He has published more than 100 papers and is known as China's Holmes. Professor Liu Yanhong hosted this lecture.
At the beginning of the lecture, Justice Hu Yunteng gave a detailed introduction to the process of Nie Shubin's case.
Then, he pointed out the detailed analysis of the four major problems faced in the retrial process: how to determine the scope of the trial, how to apply the procedural law, how to choose the trial mode of the case, and whether the case a suspect.
At the end of the lecture, Justice Hu Yunteng analyzed the legal significance of the acquittal of the retrial of Nie Shubin from three aspects. First, it showed the attitude of people's court insisted that where there was a mistake, there was a correction. Second, it has showed strict requirements on judicial and normative measures to all judicial organs around nation. Third, it showed the full implementation of the principle of evidence adjudication.
Finally, Professor Liu Yanhong made a concluding remark that Justice Hu Yunteng concluded the career of his judge with the Nie Shubin case. The lecture ended with a burst of applause from the audience.
