Deputy Director Guo Feng Held a Lecture at the Law School of Southeast University

On March 22, 2019, Deputy Director Guo Feng of the Research Office of the Supreme People's Court was invited to our hospital to hold an academic lecture on the topic “The value orientation and reference application of the Supreme People's Court Guiding Cases”. And, the host of this lecture is Dean Liu Yanhong.

At the beginning of the lecture, Professor Guo Feng took the overview of the guiding case as the entry point and described the definition of the guiding case: the case in which the referee has been effective and confirmed and published in accordance with the prescribed procedures. Then, Professor Guo Feng explained in detail the procedures and sources of the guiding cases. Then, Professor Guo believes that the guiding case has certain binding force.

Finally, Professor Guo summarized the significance and value of the guiding case from the following six aspects: First, the guiding case makes up for the lack of law. Second, the guiding cases achieve fair justice through a unified judicial scale. Third, the screening and publication of guiding cases fully reflects the openness of the judiciary and judicial democracy. Fourth, the incentive mechanism for guiding cases helps to implement the judicial responsibility system in judicial reform. Fifth, the guiding case promotes positive values in society and guides the direction of the rule of law. Sixth, the guiding case is conducive to the benign interaction between judicial practice and theoretical research. In short, the guiding case system is of great significance and value.
