On the afternoon of November 29, 2019, Professor Zhang Mingkai was invited to visit the Moot Court of Southeast University Law School to hold an academic seminar.Although the winter is approaching, the wonderful dialogue in the seminar burst out countless sparks of thought and ignited a strong academic atmosphere on site.This seminar was presided over by Professor Liu Yanhong of our college. Professor Zhang Mingkai used his profound theoretical skills to answer questions and doubts for students, and brought a spiritual feast that inspired the audience on the spot.

At the beginning of the lecture, some students raised questions about domestic violence and juvenile delinquency to Professor Zhang based on recent hot topics.Professor Zhang gave a careful answer to the students from multiple dimensions such as the rules of experience in daily life, data support and relevant provisions of foreign criminal law.For the question of whether the age of criminal responsibility should be lowered, he talked about thinking about the reality.The incidence of juvenile criminal cases is not high, and it cannot be misjudged by the high frequency of media reports.In more than 80% of countries, the minimum age of criminal responsibility is set at 14 years of age.For the punishment of minors, from the drifting theory of criminology, punishment is of little significance.The use of the malicious make-up of age rule in the common law is also not suitable for China's local situation.The determination of the age of criminal responsibility is limited by basic criminal policies. In addition, comprehensive consideration should be given to comprehensive factors such as education level and local culture.

In addition to discussing recent hot events in society, many students at the scene also consulted Professor Zhang on theoretical issues of criminal law.In response to the question of whether factual errors and erroneous constituent elements are equal, incorrect positioning of inclusion, and parallel evaluation in the field of the layman, will lead to analogy interpretation and the distinction between legal benefits of the barrier layer and the legal benefits of the back layer.The question was answered in three points, and also combined with the latest academic research findings and in-depth communication with the audience.During the seminar, many students also questioned the provisions in the sub-rules of false prosecution, traffic accident and duty crime.Professor Zhang's meticulous answers caused the students to think deeply.
