Prof. Chen Hongbing was Invited to Give a Lecture on "Judicial Recognition of Common Difficult Issues in Job Crimes".

On October 26, 2020, from 8:30 to 11:30 a.m., Chen Hongbing, professor and doctoral supervisor of Southeast University Law School, was invited to give a lecture entitled Judicial Determination of Common Difficult Issues in Job Crimes to the leaders of the Gengma County Prosecutor's Office in Yunnan Province and the Hongdong County Prosecutor's Office system in Shanxi Province, in Nanjing.

Prof. Chen Hongbing focused on common problems such as the protection of legal interests, the implementation of acts, the interpretation of constituent elements, the identification of completed attempts, and the number of accomplices and crimes in each crime, and on the main points of Chapter 8 Corruption and bribery and Chapter 9 Dereliction of duty of the Criminal Law. The charges include embezzlement, bribery, misappropriation of public funds, use of influence to accept bribes, active bribery, large amounts of property of unknown origin, and misconduct related to the crime of dereliction of duty. Professor Chen pointed out that in some of the current judicial interpretations, such as embezzlement, bribery, misappropriation of public funds, having been punished by the party discipline, political discipline; having been criminally investigated for intentional crimes; causing bad social influence as other (special) serious circumstances provisions. It is not reasonable. And confusing the elements of responsibility and prevention is also a common misunderstanding in current judicial practice.

During the three-hour lecture, Professor Chen combined criminal law theory with judicial cases, which has strong business guidance, provided unique ideas for the handling of judicial cases, broadened the horizons, and made the participants fully appreciate the charm of the systemic criminal law. Professor Chen Hongbing actively interacted with the business cadres and answered questions, which greatly mobilized the enthusiasm of the participants. The lecture was a complete success.
