The Criminal Law Team of Southeast University College of Law was Invited to Participate in the 2020 Annual Conference of the Jiangsu Provincial Law Society for Criminal Law Studies

From December 5, 2020 to December 6, 2020, the 2020 Annual Academic Conference of the Jiangsu Provincial Law Society Criminal Law Research Association was held in Zhenjiang, Jiangsu Province. Professor Liu Yanhong, Dean of Southeast University Law School, Professor Yin Ji, Associate Professor Qian Xiaoping, Associate Professor Liu Jianli and PhD students Wang Yaobin, Feng Wenjie, Zhao Long, Liu Shuangyang, Zhang Ao and Li Ruihua were invited to attend.

At the opening ceremony, Comrade Zhou Jiye, Vice Chairman of Jiangsu Provincial Committee of the Chinese People's Political Consultative Conference and President of Jiangsu Provincial Law Society, addressed the topics of Relationship between Civil Code and Criminal Law, Research on Supervisory Negligence, Research on the Theory of Justifiable Defense and Research on Artificial Intelligence. In his speech, Mr. Zhou Jiye, Vice Chairman of Jiangsu Provincial Law Society and Chairman of Jiangsu Provincial Law Society, made an outlook on the relationship between civil code and criminal law, the study of supervisory negligence, the study of the theory of self-defense and the study of artificial intelligence. Professor Sun Guoxiang, President of the Criminal Law Research Society of Jiangsu Law Society and Professor of Nanjing University Law School, highly affirmed the research contribution of our criminal law team in his annual work report, and considered that a group of scholars represented by Professor Liu Yanhong had published a series of results in authoritative journals around the promulgation of the Civil Code and the relationship between the Civil Code and criminal law, and were at the forefront of research.

In the keynote presentation session of the conference, Prof. Liu Yanhong delivered a keynote speech entitled Overall Evaluation of the Draft Criminal Law Amendment (XI) in the Era of the Civil Code, which offered unique insights into the revision of the Draft Criminal Law Amendment (XI) based on the spirit of the times contained in the Civil Code. Criminal law legislation continues to move in the direction of activist legislation, criminal law should adhere to the principle of modesty, should be used as a posterior law to make up for the lack of protection of civil law, administrative law and other prior law, should not be readily imputed criminal law. The legislative concept of civil into criminal retreat drew strong reactions and high approval from the participants, and was evaluated as high, innovative and contemporary.

In the fourth unit of supervisory negligence research, Associate Professor Qian Xiaoping as a discussant made a wonderful comment, Associate Professor Qian Xiaoping pointed out that the problem of supervisory negligence of leading cadres is often a competition of two kinds of negligence, namely, the negligence of leading cadres as supervisory personnel and the negligence of staff in their duties, how to deal with the relationship between these two kinds of negligence in criminal law, is worthy of consideration by the academic community.

In the discussion of Theme 2 of the Youth Forum, Associate Professor Liu Jianli, as the moderator, gave a wonderful introduction to the articles of the two young scholars, affirmed the theoretical value and practical value of the theme seminar, pointed out the appreciable points of the articles, and further gave certain suggestions for improvement in relation to their themes.

In the Youth Forum, Dr. Liu Shuangyang gave a speech on the topic of Criminal regulation of illegal use of personal information in the context of the Civil Code, and proposed the logic of criminalization and the path of criminalization of illegal use of personal information on the basis of elaborating the legal basis of compliance and justification of the use of personal information.

The conference fully demonstrated the excellent academic quality and solid research ability of our faculty and students, expanded the depth and breadth of academic exchanges with colleagues in the province, enhanced academic friendship, and further consolidated and strengthened the influence of our criminal law team in the academic community.
