On December 15, 2020, the 2020 Wuzhen-Internet Procuratorate Forum, organized by Zhejiang Provincial People's Procuratorate and China Prosecutor Magazine, was held simultaneously online and offline. Our doctoral student Shi Wen was invited to participate and gave a keynote speech.
The paper submitted by Dr. Shi Wen, entitled The Rigid and Flexible Criminal Law Protection of Biometric Information in the Perspective of Social System Theory, was positively evaluated by the experts and scholars and won the first prize.
In her speech, Dr. Wen Shi proposed that it is difficult to effectively regulate the social chaos of compulsory collection of biometric information in the criminal law protection model of personal cybernetics, and the criminal law protection of biometric information should take social system theory as the perspective, draw on social system theory concepts such as second-order observation theory and structural linkage, and use the principle of antecedent law as the basis for judging the criminal illegality of behavior. The principles of necessity, legality, and legitimacy are used as the prerequisites and exceptions for the application of the principle of informed consent, thereby defining the boundaries of the criminal law protection of biometric information and strengthening the interaction between the criminal law system and other legal systems to maintain the self-reproduction of the criminal law protection system.
The research results of our master's and doctoral students have continuously won awards in academic forums and essay contests nationwide, mainly thanks to the fact that under the leadership and guidance of President Liu Yanhong, our institute relies on high-end think tank research institutions such as the Judicial Big Data Research Base of the People's Court, the Research Center for Cybersecurity Rule of Law of Southeast University, and the Civil Prosecution Research Base of Southeast University, and takes the problems of the times as the guide to innovate Internet and big data, In addition, the research institute will guide graduate students to respond to the social changes in the era of network intelligence, pay close attention to the development of science and technology, respond to the changes in social needs, and cultivate their ability to handle the relationship between traditional legal theory and new issues in the era of science and technology. We also encourage graduate students to actively go out and participate in academic exchange activities to enhance the academic influence of Southeast Law.
