Recently, 11 apps (mobile phone software) including Changtu bus ticket, yikaobiguo and huomao live were ordered off shelves by Jiangsu Provincial Communication Administration. In February this year, the Bureau reported 52 apps with potential security risks and illegal collection and use of personal information, and required relevant operation units to rectify within a time limit. Changtu bus ticket and other 11 items were not rectified as scheduled in these apps. Chen Daoying, associate professor of Southeast University College, was interviewed by Xinhua daily · intersection to discuss the issue of citizens' personal information.


Chen Daoying, associate professor of Law School of Southeast University, said that with the increase of news reports or government circulars on app supervision, we can not simply think that the violation of privacy is more serious than before. In recent years, China's legislation on personal information protection has become more and more perfect. The network security law, which came into force in 2017, learns from the experience of the European Union and the United States in legislation on personal information protection. The civil code, which came into force on New Year's day this year, has more detailed provisions on personal information processing. At present, the draft of personal information protection law has been submitted to the Standing Committee of the National People's Congress for deliberation. After the promulgation and implementation of this law, the domestic laws on personal information protection will form a complete system. Most app developers have a strong willingness to comply. Under the premise of having laws to abide by, the regulatory authorities can formulate specific rules to effectively guide app developers to fulfill their compliance obligations.


The app privacy policy is long and complex, and ordinary users have no patience to read it. Chen Daoying said that to protect personal information, on the one hand, users need to improve their awareness of protection, on the other hand, they need to do it through other ways, including strengthening the inspection at the regulatory level, such as strengthening the audit obligation of app stores, and giving full play to their technical strength, such as providing app developers and users with scanning tools to check whether the privacy policy is compliant. As for the merchants exposed in CCTV's 3.15 party installing cameras to collect face data, she believes that the operators of cameras and apps, on the one hand, should regulate the collection of biometric information and implement the rules of informed consent; on the other hand, the enterprises themselves need to improve the information security management system. We should investigate the legal responsibility for the leakage of consumer privacy by enterprise insiders.
