Liu Xing, a doctoral student in our hospital, was invited to attend the meeting and asked, does administrative discretion exist in the context of artificial intelligence? A keynote speech was made. Dr. Liu Xing analyzed the relationship between the current development of artificial intelligence and administrative discretion, demonstrated the technical risks and legal challenges of artificial intelligence in automatic administration through cases, and believed that whether artificial intelligence has the ability to express will does not affect the establishment of administrative act, However, the element discretion and effect discretion in the internal structure of administrative discretion restrict the function of artificial intelligence. Although artificial intelligence has put forward new issues in the implementation of discretion benchmark and the performance of administrative due process, there is no administrative discretion based on the subject qualification theory of artificial intelligence.
