On the evening of April 29, 2021, Zhi Zhenfeng, a researcher at the Institute of law of the Chinese Academy of Social Sciences and a professor at the University of Chinese Academy of Social Sciences, was invited to the Institute of human rights of Southeast University to give a lecture on the topic of one-way transparency: rule of law and human rights in the digital era at the simulated court on the fourth floor of the law school. The lecture was presided over by Professor Gong Xianghe, executive vice president of the Institute of human rights of Southeast University. Teachers and students of law school attended the lecture together.
At the beginning of the lecture, Professor Zhi Zhenfeng raised two basic questions: 1. What is the essence of digital society? 2. What changes will digital technology bring to human society? He believes that the way of social organization (structure) determines different governance mechanisms and legal models. Law is the most profound description of social life, a comprehensive response to social problems, and also has a corresponding impact on society itself. Professor Zhi explained in detail the history of the organization of human society. He believed that without organization, there would be no human society and no human being. The essence of the organization of human society is the way to connect people, which is reflected in the relationship between people, and at the same time produces the basic unit of society. Human society can be divided into fishing and hunting society, agricultural society, industrial society and other stages. In different stages, there are different organizational modes, basic units and governance modes.
Professor Zhi Zhenfeng further pointed out that in the digital era, we are facing a series of legal dilemmas and rights crises, such as the challenge of sharing economy to administrative regulation, the dilemma of personal information protection, the formation of Internet giants, and the weaponization of artificial intelligence. Professor Zhi further asked whether code would replace rules? Will algorithm replace law? In the case of one-way transparent information, where is human freedom? Finally, Professor Zhi put forward the self salvation path of the rule of law. He believed that we should avoid the formation of the fishing net type society, and avoid human beings becoming helpless fish in the fishing net who are indifferent to each other's fate. Moreover, he also pointed out that human dignity, freedom and rights should be regarded as the boundaries of information technology.
Finally, Professor Gong Xianghe made a summary of Professor Zhi's lecture and thought that Professor Zhi's wonderful speech made us truly feel the arrival of the digital era. Digital technology has changed our way of life and expanded the space field of rule of law and human rights. Professor Gong Xianghe also pointed out that Professor Zhi's lecture has thrown out a lot of valuable questions for our theoretical research on digital human rights, provided unique research ideas, and enabled us to have a more in-depth understanding of what is digital human rights. The lecture ended with warm applause.
