Editorial Reviewer He Bosheng: Mathematical Interpretation of Legal Culture

On the evening of October 24, 2021, He Baisheng, editor and reviewer of Legal Science of Northwestern University of Political Science and Law, was invited to Southeast University Law School to give an online lecture on the theme of Mathematical Interpretation of Legal Culture. The lecture was hosted by Professor Xiong Zhanglin, Vice Dean of Southeast University College of Law, and students and teachers of the College of Law actively participated in this lecture.

 

Professor Xiong Zhanglin, Vice Dean of the Law School, expressed his warm welcome to Professor He Baisheng, an expert in the field of jurisprudence, whose research on the relationship between mathematical rationality and the causality of legal formal rationality is new and innovative, which gives us a lot of inspiration.

 

The lecture will focus on the following four aspects: first, the mathematization of reason and the rationalization of law. Second, mathematical factors in the formation of formal rationality of Western law. Third, axiomatization is an important method for constructing the theoretical system of law. Fourth, the quantification of legal values. Editor He firstly points out that mathematical rationality is a characteristic presented by Western civilization, so all aspects of Western culture are influenced by mathematical rationality, including legal culture. After being influenced by mathematical rationality, Western legal culture will certainly be reflected in legal provisions or jurisprudence. According to Editorial Reviewer He, the mathematization of rationality is probably marked by the following important signs: first, the formation of the Pythagorean-Platonic tradition; second, the creation of formal logic and axiomatic methods; third, the formation of Galileo's creation of quantitative instead of qualitative scientific research methods; fourth, the creation of Descartes' philosophy with mathematical overtones; and fifth, the influence of Newton.

 

He further pointed out that the influence of mathematical thinking on Western culture was mainly through two ways: one is through Aristotle's trinitarian logic system, and the other is through Euclid's Geometrical Origin. Since Thales and Pythagoras invented deductive mathematics, especially after Aristotle founded logic on the basis of mathematics, Westerners have held deductive logic in high esteem, incorporating more and more things into a programmatic track. According to Editor Ho, axiomatization is an important method for constructing the theoretical system of jurisprudence. The influence of this method on jurisprudence is very great, which is reflected in the following two aspects. Famous works of jurisprudence adopt the axiomatic method, such as Hobbes' Leviathan in the process of writing; Montesquieu's book On the Spirit of Law also adopts the axiomatic method. For example, the Napoleonic Code formulated in 1804 was based on the principles of freedom and equality, ownership, freedom of contract and public order and morality. These four basic principles constitute the axioms of the Napoleonic Code, and other legal provisions were formulated on the basis of these axioms.

 

During the question and answer session, the online students and teachers of the law school asked questions enthusiastically, and Professor He Bosheng patiently answered them one by one, which made the students feel the warm academic atmosphere even through the screen. Finally, Professor Xiong Zhanlin, Vice Dean of the Law School, summarized He's lecture, saying that He's lecture was very informative and described the study of legal culture from a mathematical perspective, which provided unique materials for our theoretical research.
