On September 24, 2022, Associate Professor Ji Yang and Dr. Liu Meng of our college were invited to participate in the 3rd New Crime Governance Forum and delivered an online keynote speech. The forum was hosted by the Chongqing New Crime Research Center, hosted by the Law School of Southwest University of Political Science and Law, co-organized by the Chongqing Branch of the National New Crime Research Center and Beijing Shangquan (Xiamen) Law Firm. In addition to the opening and closing ceremonies, the conference is divided into four thematic units: the new situation of new crime governance and its response, the understanding and application of the Anti-Organized Crime Law, the controversy and response to the specific scope of new crimes, and the governance of telecommunications network fraud in the context of the new law. Nearly 100 scholars from scientific research institutions, research institutions and practical departments such as Peking University, Beijing Normal University, Southwest University of Political Science and Law, Zhongnan University of Economics and Law, Wuhan University, Chinese Academy of Social Sciences, Shanghai Academy of Social Sciences, Nanjing University, Southeast University, Sichuan University, Tianjin University, Xiamen University and Chongqing Higher People's Court attended the conference.
In the first unit of the forum, Associate Professor Ji Yang delivered a speech on the topic of Judicial Logic of Helping Information Network Criminal Activities. Associate Professor Ji Yang believes that the surge in the number of crimes aiding information network criminal activities is mainly due to the judicial policy of cracking down on the whole chain of online black industry, the expanded interpretation of knowing the knowledge and the efficiency orientation of plea cases, which jointly points to the simplification of the conviction certificate, and the recognition of the simplification of the proof requires the integration of entity and procedure, and the crime of helping information network criminal activities should not become a crime of violating industry management regulations.
Dr. Liu Meng gave a keynote speech in the first unit on Applicable Methods for Helping Information Network Criminal Activities: From Priority to Accomplice Priority. Dr. Liu Meng believes that in the current trial practice in the determination of the crime of aiding information network criminal activities, by denying the establishment of one-sided accomplices, and then adopting the position of giving priority to the application of this crime rather than accomplice to the priority application, resulting in the negative consequences of the mistreatment of serious crimes and the insignificance of paragraph 3 of article 287 bis of the Criminal Law, the concept of one-sided accomplicity should be established, and the principle of restricting the subordination attribute should be adopted, and the priority application of this crime should be adopted to move from the priority application of this crime to the priority application of accomplices.
It is reported that the Chongqing New Crime Research Center is a research institute established by relying on the faculty and disciplinary advantages of the Southwest University of Political Science and Law and integrating multiple resources under the leadership of the Political and Legal Committee of the Chongqing Municipal Party Committee and the Chongqing Municipal Law Society, and specifically to carry out systematic research on the characteristics, laws, trends and governance of new criminal activities in the new era of social situation.
