On the evening of May 17, 2024, Liu Jianwen, Professor of Peking University Law School and Distinguished Professor of “Changjiang Scholars” Award Program of the Ministry of Education, was invited to give a lecture on the topic of “Functionality of Domain Jurisprudence in the Context of Chinese Modernization” for the students and faculty of Southeast University School of Law in the Moot Court. “The lecture was organized by the Law School of Southeast University and the Law School of Southeast University. The lecture was sponsored by the Law School of Southeast University and the Civil Prosecution Research Base of the Supreme People's Procuratorate (Civil Prosecution Research Center of Southeast University). Prof. Shan Pingji, deputy dean of the Law School of Southeast University and director of the Civil Prosecution Research Base of the Supreme People's Procuratorate, presided over the lecture.
At the beginning of the lecture, Prof. Shan Pingji, on behalf of all the teachers and students, expressed a warm welcome to Prof. Liu Jianwen and gave a brief introduction of Prof. Liu Jianwen's academic contributions.
Professor Liu Jianwen firstly introduced the three stages of the development of domain law, and cited cases such as the crime of false VAT invoices, pointing out the domainization of legal phenomena and the limitations of sectoral jurisprudence, and highlighting the problem-oriented, integrated and synergistic, and open and inclusive nature of domain jurisprudence. Afterwards, Prof. Liu Jianwen cited a wide range of references, deeply elaborated the relationship between domain jurisprudence and Chinese modernization, and highlighted the function of domain jurisprudence in the process of Chinese modernization. Finally, Prof. Liu Jianwen introduced to the students and teachers the concrete way of promoting the modernization of Chinese rule of law by domain jurisprudence, pointing out that it should “strengthen the legislation of key areas and emerging areas, promote the construction of service-oriented government, deepen the reform of judicial specialization, and innovate the mode of jurisprudence education”. As a conclusion, Prof. Liu Jianwen pointed out that young scholars and law students should strengthen the study of sectoral law, lay a good professional foundation, and then apply the methodology of domain jurisprudence to carry out academic research in order to be more comfortable.
In the question and answer session, Prof. Liu Jianwen answered the questions of teachers and students about “how to apply the research method of field law as a law student”, “how to look at the codification of education”, “how to deal with the problems in the study of new fields by combining the two research paradigms of sectoral and field law”, and answered the questions of teachers and students. At the end of the lecture, Prof. Shan Pingji summarized the content of the lecture and shared several learning experiences: firstly, the theme of the lecture on domain jurisprudence is far-reaching and problem-oriented; secondly, domain jurisprudence is a transformation of research paradigm; thirdly, domain jurisprudence is promising, which will have a profound impact on legislation, law enforcement, judiciary, legal education and legal research.
