On July 4, 2024, the Jiangsu Law Society Criminal Law Research Association General Assembly and 2024 Annual Meeting was grandly held in Zhangjiagang City, hosted by the Jiangsu Law Society Criminal Law Research Association and organized by the Zhangjiagang Law Society and Zhangjiagang People's Procuratorate. Our Dean Ouyang Benqi, Professor Yin Ji, Professor Liang Yunbao, Associate Professor Ji Yang, and doctoral student Guo Mingzheng attended the conference.
The opening ceremony and election ceremony will be presided over by Professor Ouyang Benqi, the dean of our college. Shao Junmin, Deputy Secretary of Zhangjiagang Municipal Party Committee and Secretary of Political and Legal Affairs Commission, first delivered a speech and warmly welcomed the attending representatives. Subsequently, Liu Wei, Executive Director of the Criminal Law Research Association of Jiangsu Provincial Law Society, reported on the preparations for the third council election, and Lv Fudong, Director of the Research Department of Jiangsu Provincial Law Society, read out the approval of the Provincial Law Society. According to the voting results of the conference, Professor Sun Guoxiang from the Law School of Nanjing University was elected as the President of the Third Council of the Criminal Law Research Association of Jiangsu Law Society. Professors Ouyang Benqi and Yin Ji from our institute were elected as Vice Presidents, Professor Li Chuan and Professor Liang Yunbao were elected as Executive Directors, and Associate Professors Liu Jianli, Qian Xiaoping, Ji Yang, and Dr. Yang Zhiqiong were elected as Directors.
In the keynote speech section of the conference, Professor Yin Ji from our institute participated in the report discussion. Based on the speeches of the speaker and the speaker, Professor Yin Ji put forward the following opinions: firstly, we should strengthen the equal protection of private enterprises in terms of criminal punishment and judicial aspects; Secondly, the issue of equal protection for private enterprises should be examined from the perspective of economic and social development; Thirdly, the inadequacy of legislative rules and judicial strategies is an important reason for the phenomenon of heavy bribery and light bribery.
On the morning of July 5th, the conference held special discussions on Research on the Understanding and Application of the Crime of Breach of Trust in Private Enterprises, Research on the Modification and Understanding of Bribery Crimes, and Research on the Punishment of Duty Crimes Involving Private Enterprises. The second unit's thematic discussion session will be chaired by Professor Liang Yunbao from our university. Under the leadership of Professor Liang Yunbao, Associate Professor Ma Chunxiao from Nanjing University Law School, Zhu Nianxi from Taizhou Intermediate People's Court, Zhang Qingbin from Peixian People's Procuratorate in Xuzhou, and Fu Junwei from Huqiu District People's Court in Suzhou gave special reports on Legislative Improvement and Academic Evaluation of Bribery Crimes in the New Era, System Positioning and Standardized Application of Special Preferential Punishment Provisions for Bribery Crimes, Research on the Understanding and Application of Aggravated Circumstances in Bribery Crimes in Criminal Law Amendment (12), and Criminal Compliance and Governance of Bribery Crimes in Private Enterprise Units.
After the special seminar of the conference, Sun Guoxiang, the President of the Third Council of the Criminal Law Research Association of Jiangsu Law Society and a professor at the Law School of Nanjing University, presented the summary of the annual conference. Professor Sun Guoxiang summarized and elaborated on how to understand and accurately apply the reasons for the commission of bribery crimes and special exemption circumstances, how to distinguish between corporate bribery crimes and bribery crimes, and how to connect with judicial policies for the protection of private enterprises when handling corporate bribery cases. He emphasized the significance of amending the provisions on corruption crimes within private enterprises in the 12th Amendment to the Criminal Law and pointed out the important role of deepening corporate compliance reform in achieving effective governance of corporate bribery. Finally, Professor Sun Guoxiang expressed sincere gratitude to the organizers and relevant staff of this conference, and the conference officially closed with warm applause.
